Section 2 (d) encompasses what has been called a “negative aspect”, a “freedom not to associate” or a “freedom from compelled (or ‘forced’) association”. However, section 2 (d) is not a constitutional right to isolation. It does not protect against all forms of involuntary association, and was not intended to protect against.. For example, in some circumstances, laws requiring organizations to include persons with whom they disagree on political, religious, or ideological matters can violate members’ freedom of association, particularly if those laws interfere with an organization’s message.26 Footnote Boy Scouts of Am. v. Freedom of association as a concept thus grew out of a series of cases in the 1950s and 1960s in which certain states were attempting to curb the activities of the National Association for the Advancement of Colored People. In the first case, the Court unanimously set aside a contempt citation imposed after the organization refused to comply.. Freedom of association encompasses both an individual’s right to join or leave groups voluntarily,. These intimate human relationships are considered forms of “intimate association.” The paradigmatic example of “intimate association” is the family. Depending on the jurisdiction it may also extend to abortion, birth control and private, adult.
